Labor-and-employment attorneys hear countless tales of abuse suffered by employees in the workplace. Employees subjected to mean-spirited or degrading treatment can often feel helpless, or even if they are proactive and make a complaint to human resources, they may simply be told to toughen up, or find a new job. With the realities of today’s increasingly stressful and competitive workplace, it is worth a moment of reflection to consider what level of civility should be expected in the workplace, and what the consequences should be, if any, for those who break such codes of conduct.
Workplaces can have tricky cultural norms, and some people will be more skilled than others at communicating. However, there is a difference between a manager or coworker who lacks tact and one who goes out of his or her way to purposefully target an individual. When one is verbally abused or intimidated, when work is sabotaged, or when humiliation is used as a tactic, that is bullying. And it is not always illegal in the United States.

CLE examined the cost of bullying in the legal profession
When Minneapolis attorney Bernice Fields organized a CLE on Bullying in the Legal Workplace, some legal secretaries told her they were afraid to ask for time off to attend.
At least one person in the audience cried at the description of being a bully’s target and what that can do to your health.
And the Minnesota Supreme Court last week confronted bullying in the profession when it suspended attorney Peter Nickitas for 30 days, followed by two years of supervised probation. There were several charges against Nickitas, but they included behavior that could readily be described as bullying. The petition said he made insulting remarks to opposing counsel during an arbitration, even screaming nose-to-nose with one attorney, the petition said. Nickitas could not be reached for comment.
The topic of bullying has taken center stage lately. The Anoka-Hennepin School District entered into a consent decree in 2012 governing discrimination and bullying after seven students there committed suicide. The Minnesota House of Representatives has passed the Safe and Supportive Schools bill requiring schools to have tougher antibullying policies. Hennepin and Ramsey County have “respectful workplace” policies that encompass bullying.

Another instance of woman-on-woman bullying in the UK, in a law firm (not unusual), where junior lawyer Pearl mounted a campaign against managing attorney Caroline causing Caroline health problems (also not unusual). Vivia Chen at Law.com, like so many others, seems intrigued by the woman-on-woman aspect and cites our WBI-Zogby 2007 findings.
